These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you," "your," or "user"), and Designbotic sp. z o.o., a Polish company located at Armii Krajowej 116/20, 81-824 Sopot, Poland ("Designbotic," "we," "us," or "our").

These Terms govern your access to and use of our website (designbotictools.com), account management platform (account.designbotictools.com), and all related services, but do not govern the use of our software products, which are covered by separate End-User License Agreements (EULAs).

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

1. ACCEPTANCE OF TERMS

Agreement to Terms
By creating an account, purchasing our services, or otherwise accessing our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Legal Authority
You represent and warrant that you have the legal authority to enter into these Terms. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Age Requirements
Our services are intended for users aged 16 years or older. By using our services, you represent that you are at least 16 years of age. Users under 16 are prohibited from creating accounts or using our services.

2. DEFINITIONS

"Account" means your user account on our account management platform at account.designbotictools.com.

"Admin User" means the primary account holder who purchases licenses and manages other users within a multi-license arrangement.

"Content" means all text, graphics, images, software, audio, video, and other materials available through our services.

"Invited User" means a user invited by an Admin User to access software under a multi-license arrangement.

"Personal Data" means any information relating to an identified or identifiable individual as defined by applicable data protection laws.

"Services" means our website, account management platform, customer support, and all related services, but excludes our software products which are governed by separate EULAs.

"Software" means our software products including Volumetrix for Revit, Terrain for Revit, Sunlight Analyzer for Revit, and Kolega.Space.

3. DESCRIPTION OF SERVICES

Website Services
We provide a website at designbotictools.com that offers information about our software products, free trial registration, customer support, and purchasing options.

Account Management Platform
We provide an account management platform at account.designbotictools.com that allows users to manage their software licenses, subscriptions, user access, and billing information.

Customer Support
We provide technical support and customer service through email (tools@designbotic.pl) and contact forms on our website.

Software Licensing
We offer software products under separate licensing agreements. The use of our software is governed by the applicable End-User License Agreements (EULAs):

4. ACCOUNT CREATION AND MANAGEMENT

Account Registration
To access certain services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Information
You agree to provide accurate, current, and complete information during account registration and to update this information to maintain its accuracy. We reserve the right to suspend or terminate accounts with incomplete or inaccurate information.

Multi-License Administration
Admin Users who purchase multiple licenses may invite other users to access their licensed software. Admin Users are fully responsible for:

• Managing invited users and their access permissions

• Ensuring all invited users comply with applicable Terms and EULAs

• All actions taken by invited users under their licensed access

• Payment and billing for all licenses under their account

Invited User Responsibilities
Invited Users must:

• Create their own account on account.designbotictools.com

• Accept and comply with these Terms and applicable EULAs

• Use services only as authorized by the Admin User

• Maintain the confidentiality of their login credentials

5. ACCEPTABLE USE POLICY

Permitted Uses
You may use our services only for lawful purposes and in accordance with these Terms. You agree to use our services in a professional and responsible manner consistent with applicable laws and regulations.

Prohibited Activities
You may not:

• Use our services for any illegal, harmful, or fraudulent purposes

• Attempt to gain unauthorized access to our systems or accounts

• Interfere with or disrupt our services or servers

• Upload or transmit viruses, malware, or other harmful code

• Impersonate another person or entity

• Collect or harvest information about other users without consent

• Use automated scripts, bots, or crawlers to access our services

• Attempt to reverse engineer, modify, or create derivative works of our services

• Share account credentials with unauthorized users

• Violate any applicable laws or regulations

Content Guidelines
Any content you submit through our services (support requests, feedback, etc.) must not contain:

• Illegal, harmful, threatening, or abusive material

• Copyrighted or proprietary material without permission

• Spam, unsolicited communications, or promotional content

• Personal information of others without consent

6. PRIVACY AND DATA PROTECTION

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) for European users.

7. SUBSCRIPTIONS AND BILLING

Subscription Services
Our software products are available under subscription plans with various billing frequencies (monthly, annual). Current pricing is available at designbotictools.com.

Free Trials
We offer 4-week free trials for new users. Free trials provide full access to software functionality and do not automatically convert to paid subscriptions.

Payment Processing
Payments are processed through Lemon Squeezy, our third-party payment processor, or through direct invoicing for enterprise customers. You agree to provide accurate payment information and authorize us to charge your payment method.

Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time, with cancellation effective at the end of your current billing period.

Price Changes
We may change subscription prices for new customers at any time. For existing subscribers, we will maintain current pricing throughout the subscription term. For price changes affecting renewals, we will provide at least 30 days advance notice.

Failed Payments
If payment fails, our payment processor will attempt collection for up to 14 days with automatic retries. During this period, service access continues. After failed collection attempts, subscriptions will be suspended until payment is resolved.

Taxes
You are responsible for all applicable taxes, duties, and assessments related to your use of our services, except for taxes on our net income.

8. REFUNDS AND CANCELLATIONS

No Refunds Policy
Due to our comprehensive 4-week free trial, all paid subscriptions are non-refundable. The free trial period allows full evaluation of our software before purchase.

Limited Exceptions
Refunds may be considered only for:

• Billing errors resulting in incorrect charges

• Technical impossibility where services cannot function despite meeting stated requirements

Cancellation Process
You may cancel subscriptions at any time through your account dashboard or by contacting support at tools@designbotic.pl. Cancellation is effective at the end of your current billing period, and you retain access until that date.

Effect of Cancellation
Upon cancellation, your right to access paid services ceases at the end of your billing period. We may retain certain account information as required by law or for legitimate business purposes.

9. TECHNICAL SUPPORT

Support Services
We provide technical support and usage guidance through:

Response Time
We commit to responding to support requests within 7 business days. Enterprise customers may receive priority support with faster response times.

Support Scope
Support services include:

• Technical troubleshooting and bug reports

• Installation and configuration help

Support Languages
Support is provided in English and Polish.

10. SERVICE AVAILABILITY AND PERFORMANCE

Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform scheduled maintenance that temporarily affects service availability.

Service Changes
We reserve the right to modify, update, or discontinue services at any time with reasonable notice to users. We will make commercially reasonable efforts to minimize service disruptions.

Third-Party Dependencies
Our services rely on third-party providers including payment processors, hosting providers, and authentication services. Service availability may be affected by third-party service issues beyond our control.

11. INTELLECTUAL PROPERTY

Our Intellectual Property
All content, features, and functionality of our services are owned by Designbotic and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without express written permission.

User Content
You retain ownership of content you submit through our services (support requests, feedback, etc.). By submitting content, you grant us a non-exclusive license to use, modify, and display such content for service operation and improvement purposes.

Software Licensing
Software licensing terms are governed by separate EULAs. These Terms do not grant any software usage rights.

Feedback
Any feedback, suggestions, or improvements you provide may be used by Designbotic without restriction or compensation.

12. DISCLAIMERS AND WARRANTIES

Service Disclaimers
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee of Availability
We do not guarantee that services will be uninterrupted, secure, or error-free. We disclaim all warranties regarding service availability, performance, or compatibility with your systems.

Third-Party Services
We are not responsible for the availability, content, or practices of third-party services, including payment processors, hosting providers, or external websites linked from our services.

13. LIMITATION OF LIABILITY

Liability Cap
IN NO EVENT SHALL DESIGNBOTIC'S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

Consequential Damages
DESIGNBOTIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Force Majeure
We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, government actions, network failures, or other force majeure events.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Designbotic, its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of services, violation of these Terms, or infringement of any third-party rights.

15. TERMINATION

Termination by You
You may terminate your account and cease using our services at any time by cancelling your subscriptions and closing your account.

Termination by Designbotic
We may suspend or terminate your account and access to services immediately if you:

• Breach these Terms or applicable EULAs

• Fail to pay fees after the grace period

• Use services for illegal or harmful purposes

• Violate our Acceptable Use Policy

Effect of Termination
Upon termination, your right to access services ceases immediately. We may retain certain data as required by law or for legitimate business purposes. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

16. GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law
These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Jurisdiction
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Poland or, where applicable, competent courts within the European Union for cross-border disputes.

Consumer Rights
Nothing in these Terms affects statutory rights that cannot be waived or limited by contract under applicable consumer protection laws.

17. GENERAL PROVISIONS

Entire Agreement
These Terms, together with our Privacy Policy and applicable EULAs, constitute the complete agreement between you and Designbotic regarding our services and supersede all prior agreements.

Amendment of Terms
We may modify these Terms from time to time. We will notify users of material changes via email or through prominent notice on our services. Your continued use after notification constitutes acceptance of modified terms.

Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Language
These Terms are prepared in English. Any translations are provided for convenience only, and the English version controls in case of conflicts.
